In days of increased vulnerability for employers about their staff and their activities – such as social media posts and personal conduct – the need to ensure that you know your staff and carry out appropriate and accurate checks has become ever more important.
Sometimes, this effort is solely concentrated at an early recruitment stage but moreover, it is during employment when the most serious and vulnerable challenges arise. Recent issues have been well publicised and a lot of negative publicity and reputational harm has been caused.

When we are recruiting, are we simply too trusting about what candidates are telling us rather than checking what we are asked to believe? Many examples spring to mind: in the UK, the Public Inquiry into the Grenfell Tower fire that cost 72 people their lives found that the fire assessor responsible for the building had “misrepresented his experience and qualifications (some of which he had invented)”, and in the US where a member of the US Congress had misrepresented his education and work record but nevertheless refused to resign from his post, or the Yahoo CEO who did resign after admitting that he didn’t have a computer science degree after all. If trust is the cornerstone of the employer/staff relationship, how do we navigate the paradox of checking facts without generating a culture of suspicion in the workplace?
Are employers being caught out by the misbehaviour of their staff more now than they used to be, or is it just more visible? Are the rights to freedom of expression, and to private and family life putting employers on the backfoot in terms of setting and maintaining reasonable standards that affect work and the workplace?
Are we making the best use of technologies so that employment decisions are the right ones? If AI can help us, what are the strengths and weaknesses, and what are the legal and practical considerations of its use?
